1. Acceptance of Terms
Please read these Terms & Conditions ("Terms") carefully. By downloading, installing, accessing, or using the video game Gambino Land (the "Game"), you ("User," "you," "your") agree to be bound by these legally binding Terms with the developer, Péter Lesovics ("I," "me," "my," "Developer"). If you do not agree to these Terms, you may not use the Game.
2. License Grant
Subject to your compliance with these Terms, I grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Game for your personal, non-commercial entertainment purposes. This license is granted solely for use through the Epic Games Store platform.
3. Epic Games Store
Your use of the Game is also governed by the Epic Games Store End User License Agreement and other relevant policies. You acknowledge and agree that Epic Games has no responsibility for the Game or its content. Epic Games shall be a third-party beneficiary to these Terms with the right to enforce them.
4. Account
a. Epic Games Account: You need an Epic Games account to access and play the Game. You are responsible for all activities conducted through your Epic Games account.
b. Account Responsibility: You must keep your account information secure and are responsible for all activities that occur under your account. You must immediately notify Epic Games of any unauthorized use of your account.
5. Intellectual Property Rights
I own all rights, title, and interest in and to the Game, including all software, code, artwork, graphics, music, sounds, characters, stories, and all other content (collectively, the "Game Content"). The Game Content is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Game, nor may you reverse engineer or attempt to extract the source code of the Game, unless laws prohibit these restrictions or you have my written permission.
6. User Conduct
You agree not to:
Use cheats, exploits, automation software, bots, hacks, mods, or any unauthorized third-party software designed to modify or interfere with the Game.
Use the Game for any commercial purpose, including but not limited to commercial advertisement, or to gather in-game items for sale.
Harass, abuse, harm, or advocate or incite harassment, abuse, or harm of another person or group.
Make the Game available to multiple users through any means, including through any form of network sharing.
Attempt to disrupt or interfere with the Game's servers, networks, or other users.
7. Virtual Items & In-Game Currency
The Game may include virtual, in-game digital items or currency ("Virtual Items"). You acknowledge that Virtual Items have no real-world value, are not redeemable for any monetary value, and are not personal property. You receive a limited license to use Virtual Items within the Game. All sales of Virtual Items are final, and no refunds will be given, except as required by applicable law or the policy of the Epic Games Store.
8. Termination
The license granted to you under these Terms is effective until terminated. You may terminate it at any time by permanently discontinuing use of the Game and deleting all copies. I may terminate this license at any time, for any reason or no reason, with or without notice. Upon termination, your right to play the Game will cease immediately.
9. Disclaimer of Warranties
THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. I DISCLAIM ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. I DO NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL I, Péter Lesovics, BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA, OR OTHER INTANGIBLES) ARISING OUT OF OR RELATING TO YOUR USE OF THE GAME, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT I HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
11. Indemnification
You agree to indemnify and hold harmless Péter Lesovics from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt arising from: (a) your use of and access to the Game; (b) your violation of any term of these Terms; or (c) your violation of any third-party right.
12. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of [Your Country/State, e.g., Hungary], without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Game shall be resolved in the competent courts located in [Your City/Region, e.g., Budapest, Hungary].
13. Changes to These Terms
I reserve the right, at my sole discretion, to modify or replace these Terms at any time. If a revision is material, I will provide at least 30 days' notice prior to any new terms taking effect, either by posting a notice within the Game, via the Epic Games Store, or by sending an email to the address associated with your account. What constitutes a material change will be determined at my sole discretion. By continuing to access or use the Game after those revisions become effective, you agree to be bound by the revised terms.
